Check with lawyer, but they go back 6 months (I think), so it shouldn't matter.

If I were you, be sure about this. No need to get into a 13 when you are currently out of work. The 13 is a terrible thing, unless you have assets to protect OR unless you make so much money and have a stable job that it doesn't matter.
