    Ch 13 and Job Loss

    What are the options when faced with a job loss?

    I filed ch 13 a year ago. My husband did not file. I lost my job this summer and got behind in the ch 13 payments. My lawyer filed for a modification which is still in process.

    I now have a new job, and the ch 13 payments are caught up per the proposed modification.

    I originally filed ch 13 to stop foreclosure - the house payments were the only thing behind. We have two cars - one is 100% in husband's name and is not included in the bankruptcy. The other was current at the time of the bankruptcy, but is in my name and is in the bankruptcy.

    My husband has been told he will be losing his job in a few weeks - maybe a month or two.

    With his job loss there is no way we can make the house payment. Not even for a month or two while he finds work. He has to find work at the same salary for us to make ends meet - which is unlikely in his industry.

    So, what are our options? The only option my lawyer's office will tell me about is lowering the payments for a bit while my husband looks for a new job. But even without the ch 13 payment, we can't make the house payment. And that would only make my payment higher later on and we are already stretched pretty thin on what it is.

    Any other options? Thoughts?

    Sorry to hear about the job loss - been there, done that; very hard. Hopefully something will come along quickly for you.

    There are several things you should be looking at - one of which you already know: you cannot afford your house even w/out the 13 payment (as you stated). Options to look at are: surrender the house and rent something cheaper, staying in your plan - or convert to a 7 (assuming you qualify).

    Talk to your lawyer and find out about converting to Ch. 7 - and what the good/bad will be if you do so vs. staying in Ch. 13.
