    need help

    ok here it goes. I did a 13 to save my house, and it hasn't discharged yet (next week) they said we make more than we do now and our payments are so high that i don't have enough money to pay my bills car pmnts insurance food ele phone just everyday stuff . the money i'm left with is only 1600.00 a month to take care family of 6 and still make a truck pmnt and all med bills and other bills.. my question is should i pull out of it and file chapter 7 and see i do loose the house. because at this point i don't care any more..and i did forget to mention i the mom works two jobs and i been doing this for almost 2 years and it adds up to 60 or more hours a week..i'm tired i just wanted a fresh strart and now i'm worse the chapter 13 than i was before. please help i hope i exlpain it ok and you get the point what im trying to say. thanks

    When you say, "it hasn't been discharged," do you mean your plan hasn't been confirmed? I'm going to assume so.

    Without more information, it is hard to say whether converting to a Chap 7 is a good idea or evan an option. But, since you say you filed a 13 to save your house and you can't afford the plan payment, my guess is you can't afford your house and giving it up and filing (or converting to) a Chap 7 may be your best move. It's also possible that there is a problem with the plan and perhaps your attorney sucks.

    If you want people here to help try to figure out what the problem is, you may want to provide the following info:

    What is your gross and net income?
    How much is your house payment? What is its value and how much do you owe? How far behind are you in payments?
    How much is your care payment? What is its value and how much do you owe? Is the car payment current?
    Do you have any other secured debt?
    Do you have any non-exempt assets that you are trying to keep?
    Do you have any studen loan payments, overdue taxes or other non-dischargeable debt?
    How much are your out of pocket medical expenses?
