    Is this ever going to happen?

    I cannot scrape up $700 for anything. I'm desperate to get this going. We are not able to make car payments due to old CU taking $1300 out of checking with no authorization. I got caller ID today and am blocking collection calls, my high of the day. So far, we are 60-90 days behind on cc's, so guess I'll have to put up with the calls and call blocking for one more month. Guess it's good to put more time between filing and last credit card usage. I tell myself it'll be ok, even if a suit gets going, we'll be able to file before it goes anywhere. Getting up early and pulling money out of old bank before youknowwho takes it and then we won't be able to eat or pay car insurance. This is the worst, I am getting depressed I feel like asking family for money to file, but I know I'll get lectured til the end of time, it might be worth it though.

    I dont know your situation but if your old credit union is taking money out of your, I'm assuming, newer checking account, why dont you dispute the charges with your bank, since they have no authorization?

      My bank told me that I have to prove it is fraud, since the CU took it out via electronic check, not one of my checks either. I figure that so ain't gonna happen, they are not going to admit that they didn't have authorization.

        Since you havent filed yet and the CU has your account number, maybe you should go elsewhere and open another checking account with another bank. Once I filed, I thought my creditors would be done with trying to withdraw from my checking account since they would be violating the automatic stay. Well, I was wrong. One of my creditors withdrew $500 from my account on my payday, so I had to show the bank my BK papers and that this particular creditor was included in my BK. I did get my money back, and in the meantime, I went to a different bank and opened an account, and moved my direct deposit to my new bank account.

          We did switch over retirement and another DD, but they didn't have time to switch to new bank, and looking at bank on the 1st, nothing was pending, so I assumed we were good. Tomorrows pay going to old bank cuz someone didn't double check. I have learned my lesson and don't trust any bank now. I have such horrible anxiety over all this. I can't believe how out of hand its all gotten.

            Looks like the best bet is to file chapter 7.

            Anyway, take a deep breath. Pull out your cash out of the bank if you have to. Also, if you get sued, just file a response to the court indicating that you are going to fight it. If all else fails, find a lawyer and file a 7. You can do it for 1000. If you don't have the 1k, then try to work something out with the lawyer.

            You have options.

            Don't quit.

              I'm just curious where you got this suggestion from her post? The upfront out-of-pocket for a 7 is more. It won't really help her in the short term which is where she is facing the current issues.

              OkieBlue.. I promise it will get better. This will just be a bad memory in a few months. I remember reading about the automated payment that you requested to have stopped and I know how that can cause a domino effect on everything else. I hope that you can file soon so the phone will stop ringing, but personally, I'd unplug the dang thing and let that, be that. Just keep strong. You will get past this. Right now you're just at the end of the beginning.

                Thanks H! I know it'll get better as soon as we can file, now it looks like it'll be next month, and the calls have dropped off, so that makes me paranoid. I opened up statements yesterday and walked around in a daze, I felt so shocked at how deep we are in it this and how I'm not managing to help pull us out. I am tired of things happening to me and want to make things happen!
