Perhaps you mean you will need to file 2010 taxes...the 2009 ones would be a tad late. No one says you have to file any earlier than April 15, or one can get the automatic extension of time to file from the IRS, if one has a sneaking suspicion they will be getting a refund and want to be sure that it does not go elsewhere.

Actually, that's not true. The trustee could hold up the closing of the OPs Chapter 13 case if any expected refund isn't turned in. If the OPs plan called for the income tax refund to be turned in to the trustee, the 2010 tax refund would be part of the plan.

True enough, however, if the Plan is complete, then it is complete without the refund if it completes in March. I could be wrong, but once the Plan is complete, the trustee really would have no reason to hold the Plan open, and not proceed with the administration of the discharge and closure.

But it's not complete if 2010 taxes/refund isn't administered. We're in the same position and our attorney told us to file our taxes early, so that if there is any refund we can turn it in to the trustee promptly and not delay the closing of our 13.
