    CH13 just a few questions..........

    Ok.......

    So I met with an Attorney, he gave me several forms to fill out and I did that. Went back to him and dropped them off and scheduled a meeting with him last week.

    First meeting the paperwork was incorrect, had me listed as a CH7, which is not correct so he had me sign some forms and said he would send over via PDF the correct forms with correct numbers and E-File the case. I spoke to him early this week and he seemed irate that I was reading the BK Forums!!!

    Waited all this week and no emails, no answer either! I want to review the petition before he "E-files" it.

    So with that said I will ask upon you all in fourm land for some suggestions:

    1. I have a Home with $260,000 on the 1st, and $168,000 on the 2nd....I will surrender this home as I am no longer living there....I moved out of state.

    2. I have $33,000 CC debt over 3 cards.

    3. I have a Ford Truck loan with $14,700 as payoff. (I might have this sold)

    4. I have a boat that I own and want to keep. I understand that the value of it must be paid to my creditors...the problem I have is it costs $100 a month to store it. Can I use something in Schedule "J" to make this ok?

    MY BIG concerns are, how will the bank handle taking my home back? Will they sell it on the Court House steps? I will owe the difference? The home is currently listed for sale at $455,000 with several offers around 350K...I owe about 425.

    I WANT to keep my boat. PERIOD. How can I do this if I DO NOT do a 100% payback? Best case is I owe 33K and can EASILY pay that back at 100%. Worst case is I am 100K short on the house sale and I will have 133K to pay pack over 60 months...will be hard for me to pay 2K+ a month to make it 100%.

    I still am not clear on the "J" part of allowable living exp. I read so much on hear that you can get TOTALLY screwed...or given a workable and doable payment.

    You won't owe anything for your surrendered home after the completion of your bankruptcy. Your debt to the lender will be discharged. No worries there. The lender will still have to follow the foreclosure laws in your state.

    By all means make sure you review the petition before your attorney files it. You want to make sure that you are being allowed enough money to have a workable plan. Call your attorney again today and reiterate that you want to review before it is filed. Set up another appointment if you have to, and go over all the figures carefully. (Especially since he had it as a 7 and not a 13...)
