Question about being behind on our first and second mortgages

    Question about being behind on our first and second mortgages

    We are filing at the end of November, and just haven't been able to make ends meet lately. We're behind at least 2 months on our 1st mortgage, and several months on our 2nd. We are keeping the house, and 2 cars. The house will be outside the plan, the cars inside the plan. We are going to attempt to strip the 2nd.

    I have been sending the 1st mortgage company money as I can, even though it's not entire payments, trying to at least remain on somewhat friendly terms. Should I continue to do this or not? My attorney said we'd put whatever we are overdue into arrears. I was just wondering who else has been in this situation, where you're behind...but still get to keep the house. I'm afraid that because I'm not making steady, full payments, and on time for that matter, that the 1st will object and we won't get to keep the house.

    If you can't make the mortgage payment now, how are you going to make it plus pay the back payments in the plan? Are you still paying credit cards?

      We're saving up to pay the attorney. Otherwise, it would be fine. I was just trying to figure out how much trouble it would be to miss this payment, or lower it, so that we can file in November, instead of waiting another month. We have to file by the end of the year, for some specific reasons. I'd like to just get it over with.

      And no, we aren't paying credit cards. The only thing I'm paying on is the cars and the house, minus the 2nd mortgage.

        Got it. Sorry, a lot of people just don't have the money to pay the mortgage buy try and keep the house anyway, I didn't think about saving for the attorney.
        It is not a problem to be behind on the mortgage when you file, it will just be a higher minimum amount you will need to pay back in your plan. They can not object based on the fact you are behind on your mortgage, you are filing bankruptcy after all, most people are behind.
        If you are going to be filing soon it is no problem at all to skip a month or two on your mortgage first.

            Okay, that's what I figured. I could wait another month, but I don't want to. If it's not going to be a huge problem, since I'm already behind anyway, I'd rather file now and get it all started than keep waiting. We've been waiting to file since August. I realize a lot of people wait longer than that, but this is killing me! I just want it done so we can get going on our free-start!!
