We have two vehicles. We are past due on vehicle #1. Current on vehicle #2. Due to this, the attorney said we would to have both within the BK plan. Fast forward to now. We have decided with our attorney's approval to surrender vehicle #1 (past due) and replace it with a less expensive vehicle. Since we will now have two vehicles that are not past due, (surrendering the one that is)...can these be paid outside of the BK plan?

Have you already filed your plan? If so, you will need the trustee's approval to incur the debt of getting another car. I was past due on my vehicle when I first filed, and it was included in my plan. After being in my plan for about a year and a half, I decided to surrender that vehicle, and got the BK courts approval to incur the debt of financing another vehicle, which is paid outside of my plan.Originally posted by steveok View PostFiled: 5/22/07; 341 Hearing: 6/27/07;
