We will be filing for Ch 13 within the next few weeks, and one of the credit cards that will be included in the BK is with the same credit union in which we have a mortgage on our rental property. The mortgage is in good standing and will not be included in the plan, and the interest rate is great. Even though the property is underwater, we are getting some positive cash flow from the rental.
So, my question is this: Can the credit union take some kind of action against the mortgage if we have defaulted on the credit card account? (Based on advice that I read elsewhere on this forum, we have already moved our savings to another credit union.)
