    Payment Changed/Confirmation

    I spoke with my atty yesterday and the trustee wants to increase my payments by only $80. He actually mentioned it at the 341 so I expected it to go up but at the time he said he wanted $200 more. I am so thankful that my atty was able to get that adjusted down! I decided to just let it be and to not cause any problems to keep me from being confirmed.

    My confirmation hearing is set for 10/14. My atty submitted an amended plan yesterday. Will that delay my hearing? Also, will the 28 days for objections start over from yesterday OR will it still be from original filing date?

    Since your attorney is filing an amended plan that he/she and your trustee have already negotiated, your confirmation shouldn't be delayed.

    According the the Bankruptcy Timeline at http://www.mcdonaldlawaz.com/timeline2.htm , "If the Trustee or other party of interest objects to the debtor's claim of exempt property, they must make their objection within 30 days after the 341 meeting." The date used in this case is your assigned 341 meeting date. If your 341 was rescheduled from the intial date, the first 341 date is still the one used.

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      thanks you are right! My atty called me today and everything is set for confirmation tomorrow even with the amended plan. AND I don't need to be there!
