    How long to get confirmed?

    I filed Chapter 13 in August 2009, had the 341 meeting in September, and have been paying the plan amount (which was amended about 8 months ago to a lower amount due to an increased alimony obligation). The trustee filed a motion back in February to extend the objection period for 45 days but there's been no activity on the case since then aside from a certification of mailing due to one creditor transferring the debt to some attorney/debt collector. I've made 14 payments against the plan (presumably 46 left) but no word on whether it's been confirmed - nothing on 13datacenter, and nothing on PACER. The attorney says "don't worry about it" but how long should it take, and what's the real benefit to being confirmed versus being in this state of limbo?

    Thanks in advance for any info from those who have been through this debacle...

    I filed in August 2009 as well and have not been confirmed.

      I filed in May of 2007, and my plan was confirmed in August of 2007.
      Filed: 5/22/07; 341 Hearing: 6/27/07;
      Confirmed: 8/13/07; DISCHARGED 4/17/2012

        We filed in March 2009, and got confirmed May 2010. VERY slow, at least here in AZ!

          I filed chap 13 Sept 1st by 341 is Oct17 and my confirmation meeting is Nov 19 in NY it goes pretty fast

            Call your lawyer and ask him/her to find out where your case is at the moment. It's the only way to know what's going on in *your* case.

            Average confirmation times really mean nothing - they vary widely depending on the state, the trustee, and the specifics of the case (for ex, cases with objections tend to move more slowly to confirmation).

            Your court and trustee will move along at their own pace and you can't control it. Just keep making your payments on time - that's the only thing you really do control in Ch 13.

            07/18/06 - Confirmation Hearing - not confirmed, 3 objections
            10/05/06 - Hearing to resolve 2 trustee objections
            01/24/07 - Judge dismisses mortgage company objection
            09/27/07 - Confirmed at last!
            06/10/11 - Trustee confirms all payments made
            08/10/11 - DISCHARGED !

            10/02/11 - CASE CLOSED
            Countdown: 60 months paid, 0 months to go

              We filed July 2008 and it took almost 20 months to get confirmed. But we had an issue with our cram-down and our credit union that held things up...

              I think in most cases it really doesn't matter how long it takes - from what I've heard the only state I've heard where the 60 month countdown starts at CONFIRMATION instead of filing date is Michigan...

                my confirmation hearing was 21 days after my 341.... I thought it would be a done deal... and boy was I ever wrong... new date in Nov 15 (which is the BAR date?). So the lesson is be prepared for the worst at your 1st confirmation hearing but of course always hope for the best!
