    Agreed!! Attorney is paid for by you and should fight for you! Trustee and U.S. Trustee are more than enough mouths to speak up for the creditors.

      Don't file until you are comfortable (or at least understand) your plan. My lawyer really helped us. First, my wife did not file--only me since the credit card debt is in my name. Still, all family income and expenses are considered anyway. Not to mention assets. Now since my wife wasn't filing, half of our assets are exempt (tenants by the entirety in FL). Huge advantage to us. Second, my wife's credit score is maintained. We do not make a big income, but based on lawyer stategy, our payment came to $94.00 for 60 months. We also delayed filing. Right after our first meet, I was advised to get a car....fo0r obvious reasons. So I did. I am good for 36 months. My wife got her own lease as well. Also, I was told to get my cellphone of choice and account (I didn't have one before). So, I did that as well. Then I stopped paying my unsecured debt--who cares about nonpayment anymore. Went without payment for 7 months--no lawsuits--some phone calls, etc. Filed 10/25/2010. I couldn't be happier. I get the decent payment and my wife's credit remains intact. 20 something years ago when we got married, I told my wife that we weren't going to get any joint credit cards..turns out it was a good move. Anyway, keep at it. There will always be some flexibility built in. After your filing, you will probably find places to cut back even more and use those monies for some entertainment and gifts. On the other hand, your lawyer and creditors and the trustee will tell you that you had your fun and entertainment and gifts at someone else's expense.
