    What is the cheapest monthly plan? Is it $200 or could it be $25?

    Ok- I have SSDI as income. $787. I have a mortgage- on the house. I have a 1998 car. Which is paid for.

    It is hard to get thru the month on $787. From that- the mortgage, heat, electric, water, phone, insurance, taxes, keeping a car on the road- food and clothes.

    From what it looks like- the trustee fee would be $125. Not counting the funds to pay credit cards. Can this fee be waived?

    I have a 15K judgment- and thus could not sell my house. It is 2 years before I can chapter 7.

    I would like to convert my current house- into one that is not on the busy street.

    I can not afford to file bankruptcy.

    Even if I do chapter 7- it would be 2-3 years before I could get approved for a new mortgage.

    The thing is- I dont know how to be able to move to another house.


    $787 - $125 = $662... and that is just the trustee fee.

    $662 would be even tougher to live off of.

    Up till now- I concluded- that I simply can not do ANYTHING.

    if SSDI is your only source of income - no one can collect from you or garnish wages. You will be extremely hard pressed to get a Ch. 13 plan approved on such an income.

      So basically I do not have enough money to file a chapter 13 bankruptcy. Ouch.

        why would you not consider a chapter 7??? that's usually what happens if you do not qualify under certain circumstances for a chapter 13...i do believe pa is a homestead state....

          If I dont pay my mortgage- THEN I could afford $200 a month to a 13. (my mortgage is $225)

              Unfortunately, you will not be approved for a ch.13 due to lack of feasibility. You can sell your home, but you'll have to pay off the judgment with the proceeds. I think your only other option would be to wait the 2 years. I'm guessing that you have quite a bit of equity and therefore don't want to walk away & let the bank foreclose?
              Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
              0% payback to unsecured creditors, 56 payments down, 4 to go....

                The range- is break even to max of 20k equity.

                So- assume- I wait the 2 years. --I wonder if I could list it now- thinking it takes a while to sell.

                Too bad I could not just trade it.
