We filed for a chap. 13 modification on August 2 for payment reduction effective August 2010. We were supposed to have our confirmation hearing today, but my attorney had to leave town due to a family emergency so it has been postponed to November.
We requested a payment reduction due to decrease in income - but the original amount is still being deducted from my paycheck. This is obviously causing problems since the trustee is taking out way more than we can afford (and it looks like this will go on until November).
Once we are confirmed with the new plan, is it typical that we will be refunded the overpayment amount or are we just out of luck?
