    One step closer to discharge

    I finally got a letter from the trustee and a letter that the judge has signed to stop our wage garnishment. We were told to pay our morgage starting in October.She says there doing audit but we are complete, just not discharged yet.I think it's just a matter of time for the audit to be complete.It was great news to know our paychecks wont have the wage garnishments. Been a little over 5 years. Next we need a new (used) car soon. I hate to get a loan so soon after this. I don't want to start getting loans and falling behind.

    I am routing for you. I would love to see someone from Western PA get their discharge, then I could have some hope. Our wage garnishment stopped in Jan of 2009.

      Wow, I can't believe your garnishments have been stopped that long ago and your not discharged.That doesn't seem promising for me.Well atleast my pays will be back to normal.I called mortgage comany for payment book they said I should get vouchers until the case is discharged.

        Hey soccermom,

        I'm from western pa area too and awaiting my discharge after completing my payment plan. Can I ask why they said it is taking soo long for your final discharge. Wow over a year since wage attachment stopped and still waiting for final discharge! I'm going bonkers waiting too, but I have only been waiting since July. There is a status conference set for December of this year and I'm hoping then to have a discharge, but now I'm wondering if that is wishful thinking.

          I'm from western pa too, got a letter from some chicky (not trustee) saying that an audit had to be completed. The trustee has paid my claims (after almost 5 years) and now waiting for checks to clear. I'm hoping that once all checks clear it might speed things up, but after reading soccermom's post about wage attachment being stopped in January of 2009 and she still waiting for discharge, I too am discouraged. Was hoping that some good would come out of status conference in December. Looks like being in the western pa district is not a good thing. :O(

            Basically my emails are stating that they are doing everything they can to get the audit done but are backlogged due to the 2005 rush before the new law kicked in, blah, blah, blah. We will forward your concerns to our closing department, blah, blah, blah. If you have any further questions please contact your attorney.

            My last email started out with: As you have been informed previously.....

            My attorney says that they can't get involved in the audit/trustee issues.

            I was emailing them every few months, but decided to cut back in the hopes they were sticking me at the end of the pile out of spite and would let me move up if I left them alone, but I am probably going to resume. Maybe I should email them every week.

            Rexycar, you said they finally paid your claims after 5 years. They held our payments too. I wonder how much extra money they are making in interest by sitting on this money for so long.

              My status changed today on the ndc site, status say : (J)COMPLETED FUNDS TO CREDITORS

                One other thing, for some reason my payback to unsecured went up 6% today it has never moved before. Maybe becuase my total paid was higher than my plan base.Not sure. I just can't wait until it over.Just like everyone else.

                  A status conference, from what I can gather, is where the trustee has to tell the judge of the status case, either recommend a discharge or other action taking. I think it is a way to get the trustee off her butt. My lawer filed a motion for discharge and in response to that the judge setup the status conference. My lawyer's words were something like he would file the motion for discharge to "get the trustee's butt moving"

                    When they paid my claims (still waiting for all checks to clear), my unsecured went from 100% to I can't remember what, so I think they adjust that once they pay claims and/or audit is in progress or done? It seems like you are right though that you are getting closer to that discharge.

                    I haven't checked the ndc website lately to see what it says, but mine still said active the last time I looked, so maybe that changes when all checks of cleared?

                      This also changed.Where it says date case closed, it said 7/18/2010 last week.I hope nothing changed.
                      I wish I could stop looking at the ndc site. I check it everyday.Ithink it stresses me out when I don't see the discharge.

                        Jsperk,

                        I check the data 13 center website and Pacer every day too hoping for a discharge or even signs of progress. Did you check in Pacer under documents to see what has been filed lately on your case? I thought and I could be wrong, but I thought the discharge came first and then shortly thereafter they officially close the case.
