    3 Months into Ch. 13, New Contract Job

    To summarize, I'm early into a Ch.13 (3 months) and just secured a new contract job (1099). I will be making almost double my current pay rate, but the problem is that I will have to wait up to 60 days to get my first check (bill after 30 days, then net 30).

    I live in North Carolina. How late can I be on my payments before I put my plan in jeopardy? Once I start getting paid, catching up will be no problem.

    Just seeing what my options are. My in-laws have offered to loan us what we need during this time, but I want to avoid that if possible.

    Also, I'm still debating when to tell my attorney. After I get my first check?

    You need to discuss this with your attorney ASAP. Never be late with one payment in a Chapter 13 as you risk dismissal (worst thing you can do). It is possible your attorney can have the trustee delay one or two plan payments. Also, with the income increase, your plan will probably have to be modified and you would have had to contact your attorney anyway due to the salary change.
