I have been separated from my wife for 6 months and have agreed to pay her 400 dollars a month but it isn't court ordered because nether of of can afford to do a legal separation and i have my plate full with the chapter 13. My lawyer says get your agreement in writing with her signature and it may fly past the trustee, anyone think different?

You could always, pro se, ask the court to approve a temporary maintenance agreement between you and your wife, providing that your wife agrees to sign the agreement.
You could also record an agreement of temporary maintenance with the clerk and recorder's office.
You may also be able to file for legal separation status pro se, again, if your wife agrees.
