    Plan confirmed, what now?

    Had my confirmation hearing on 8-24-10, the judge stated my plan would be confirmed, on pacer and ch13datacenter it does not state the date that my plan was confirmed, how long does that take to occur and what should I expect next? I filed pro-se and my payments are being deducted via payroll deduction every 2 weeks. Thanks in advance for any help!

    It took 2 weeks after our 341 for it to be Confirmed. It shows up on Data13 pretty quickly. That is how we knew we were Confirmed.

      You will receive a "snail mail" letter from the court with the judge's signature that your plan has been confirmed. Depending on how backed up your local court is, this could take a while to arrive.

      Unless you get notification of filed objections by creditors or your trustee, just keep making your payments on time.

      You can see if the confirmation is documented on 13Network http://www.13network.com/ or National Data Center https://www.13datacenter.com/data/home_debtors.asp .

      Most trustees are on both, but there are a few trustees who are on only one or the other. Both are free - you sign up to create an account. It's a good idea to sign up for one or the other to track your trustee's payments and see the current status of your Ch 13. It's much easier to see that here than on PACER.

        I was confirmed and got a Form 23 to fill out.

        How long do I have to do this ?

          I'm assuming that the form you received is Form B23 Debtor’s Certification of Completion of Financial Management Course.

          Because the bk law only states the required post-filing financial management course must be completed before your Ch 13 can be discharged, technically you have until the end of your Ch 13 to complete it. However, most 13ers get it out of the way and complete it sometime during the first year or two after confirmation. No sense putting it off. This isn't something to forget to do!

          If you filed with a lawyer, then once you've successfully completed the financial management course, you let your lawyer know. Your lawyer notifies the court the requirement is met and your record is updated to reflect this.

          If you filed your Ch 13 yourself, then contact your bk court clerk and find out what the expectations are for timing, whether the form has to be notarized, how it needs to be sent to the court, etc. When you complete the financial management course, fill in the form following the court clerk's instructions, make a copy for your own records, and send it in.
