We hired an attorney and will be trying to file a chapter 13, my problem is my husband is on social security disability and my sole income is from my family run daycare can we file and use his income or will they only except mine.

Social Security is not "income" for the purpose of determining if you are above or below median income hence whether you can file a 36 month Chapter 13 or are required to file a 60 month Chapter 13. Social Security is used to determine your disposable income as it relates to the Plan payment so, yes, the Social Security income is reported on Schedule I and will bolster your ability to make a Plan payment.
