    Question...when we filed for 13 in June, we filed on our local hospital in the amount of about 1k. Now, I have concerns as my physician, OB/GYN and pediatrician all have privileges at the same hospital and should or when something happens this is where they are going to want me (or my husband and daughter) to go. Will the hospital accept that of me or my family? How would I handle this?

    It is important to note that there are several other hospitals in the area, but I would have to travel longer and probably find new care providers, which I do not want to do. Additionally, I did not file on any of my doctors so that have no idea of my concerns regarding the hospital. We are in a 0% payback as well.

    As far as I know, the hospital can't refuse you. Whether or not there would be hassle involved, I don't know.

    Out of curiosity though - how are things going for you? Have wondered... Have you been confirmed?
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      Hello SMinGA,

      Thank you for your thoughts. We are doing ok. Learning how to live on budget, paying the bills timely and trying to save. Definitally giving more though to purchases!

      We had the 341 on 7/2, had the credit union show up and grill us a little. Other than that it went ok. It looked like the budget we had might have to be modified and I am entitled to receive a large amount of money in November due to an inheritance, so we thought that it would be lost.

      Luckily, the budget was not questioned, and it the trustees report did not mention anything about the inheritanace. Thankfully, the spendthrift provision held up well.

      We did receive two objections to conformation. One from Sterling Jewerlers and the other from the local Credit Union. Sterling Jewelers, we just returned the merchandise and the credit union objected based on what they said was "purchase money" on a truck, when it was actually not, but a credit card we had through them. I wented to fight with them as we had a winning argument but my atty felt it was prudent to get it resolved and us confirmed since we flew by on the budget and trust. This we ended up having to pay them $27k, instead of the $23,221 we owed on the truck.

      The trustee has recommended us for conformation, and I believe that is set for August 23. Right now our payments for $690/month, and thats just arrears, trustee, atty fee, and the secured truck. 0% to unsecured which was about $100k with all the interest, fees, etc.

      We still await HSBC/Best Buy to file their claim. I have concerns about how they will file, but I guess only time will tell. Other than that, I honestly think we have done extremely well and have been set up for a positive future with a new frame of mind. Hopefully we get confirmed and all goes well here on out.

      I did run into a small issue with having a bk. We traveled to Myrtle Beach for a vacation (first time it was totally on a budget, saved in advance, and in cash and it was a wonderful feeling!). We drove my new escape, and as my luck would hold, my husband rear ended another vehicle and rendered my vehicle inoperable for two days. We tried to rent a vehicle and a combination of the fact that we drove to the location and did not have airfair, did not have a credit card (only debit) and would not pass a credit check left us without the ability to rent a car. The lady at Hertz literally laughed at me when I told her we just wrecked my vehicle, only had a debit card, and no we would probably would not pass a credit check as they would have to do. Oh well...lesson learned.

      How are you doing? Still planning on filing? You a single mom in georgia?

        SM is initials for my first & middle name. Never occurred to me it might be mistaken for single mom LOL.

        We're doing well. Got the mortgage modified so its current & the payment went down a little, we're prepared to file ch. 13 if/when we have to but not rushing into it. Have not been able to get financing for a replacement car for me - so I continue to drive a beater and save $. It may hold out for another month or another year. Who knows? Have given up on trying to finance anything for now but have enough saved that I can get into something reliable for cash if I have to.

        The holding factor is our other vehicle, the one hubby drives. The lender (USAA, out of state from us) so far has been quiet. They've charged it off, but of course we still owe it & they hold the title. I'm making small payments, since they charged it off there is no interest at least.

        Ultimately if USAA does not get aggressive and no one files suit against me - we won't file ch. 13. Will just hold off (3 years!?!) til we can file ch. 7. If we need to file sooner, we can file ch. 13 - pay the atty fees w/ cash saved - and the plan will probably just pay off the USAA vehicle & trustee fees.

        Not worried about suits against hubby - his net income is below what can be garnished and he is only one 1 bank account. But can't afford to get my income garnished.

          Legally you can be refused non-emergency care at the hospital. In reality, it is unlikely. Hospitals get bankruptcy fileings every day, you are just as likely to pay next time as the next person that walks in, considering most of the bills do NOT get paid at a hospital that are not paid by insurance.

          Private doctors are another matter. They will sometimes refuse to see you, it would be up to the doctor/practice. If you currently have insurance/medicare there is a good chance they will continue to see you however.

          I wouldn't worry too much about it. When we filed I included my primary hospital, and they have me scheduled for a non-emergency surgery in November, that I will have about a $4000 copay for. They had no issues with the amounts I included in bankruptcy.
