    Filed Schedules/Financial Affiars/Repayment Plan 10 Days After Court Deadline

    I filed my Ch.13 emergency bankruptcy petition on 7/13/2010 to stop 2foreclosures on rental properties. This is my 2nd petition within the space of a year.

    The court sent me an Order and Notice Regarding Filing of Documents and Notice of Proposed Dismissal stating that my case filed on 7/13/10 had deficiencies which "will result in dismissal of the case" if not completely and accurately corrected. The Order required that I file my Summary of Schedules, my Statement of Financial Affairs, my Statement of Current Monthly Income, and my Ch. 13 plan within 14 days of 7/13/10.

    Unfortunately I didn't complete and submit the documents until 10 days after the court's 14-day deadline.

    I haven't seen any status changes on the Hearing /Deadline section of the Pacer site other than a date under the Terminated column corresponding to the date I filed the paperwork (i.e., 10 days late).

    Will the case be dismissed or is there any hope of the court allowing the petition to go forward??

    Why do you keep doing that? It's called "serial filing", and I don't think the courts like it much. Bankruptcy procedures and deadlines are not just "good ideas", they are rules, and we all have to follow them, attorneys and pro se alike. If you didn't file a motion for an extension of time to file the stuff late, then maybe you can find a way procedurally to salvage the case, but I don't know what that might be. Try asking your case manager at the clerk's office, maybe.
