Can someone please help? We are in the process of filing for ch 13, with a payment of 185.00, surrendering our vehicle. We are family of 4 under median income. We are barely making ends met. My concern is if my wife who currently works part time gets a full time job and our income increases some but we are still under the median income can they increase the payment since we supposedly would have more DMI.

Are you claiming IRS standards on your schedule J? If not, then when she begins to work more, then you can adjust your expenses upwards as well to offset the additional income.
If you're already claiming the IRS standards, you can't really adjust there, but if your transportation costs increase or anything like that due to her working more, then you can adjust that...Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11

no we are not meeting all IRS standards. Had to trim expenses to be able to show DMI to cover the 185.00 payment. Ch 7 is not an option for us.Comment
