    In a 13 and giving up hpuse

    Hi all. Was wondering if someone can help me out? We are most likely going to call our attorney on Friday to tell him we just cannot handle the house payment and trustee payment anymore. We filed the 13 to keep the house and strip our 2nd but it is just too much. I am looking for a job and as everyone knows the economy sucks. I have a job but only making 1/2 of what I made.

    So I have two questions.

    1. Does anyone know about how long we might have in the house? We are in CT, a judicial state, and have Wells Fargo.

    2. I really want to dump this house and move on with a fresh start. However, my husband is very stubborn and is really attached here. But obviously will move if necessary. My question is, after our 13 is dismissed, is there any way Wells Fargo might want to work something out? Just wondering if they would want to work something out rather than have another empty house? But really, I want to move. I am only asking out here because I know my husband has some glimmer of hope, for some crazy reason.

    Wells Fargo would only work with you if you qualify for any modification or refinancing. If you are making less and have employmnt problems/issues, they won't. Also, have you notified your Chapter 13 attorney that you are making less than when you filed? You may be able to modify your chapter 13 plan.

    Also, if you give up your home and with a BK on your credit reports, it could be quite a while before you will be able to obtain another mortgage for another home. There are many things you have to consider and you both should sit down and talk with your attorney.
