Dell Financial - Secured or Unsecured?

We have some electronics that were financed through Dell. Our attorney listed them as an unsecured creditor, but said that they may come back and claim to be secured in which case we would either be forced to raise our monthly plan payment or return the items financed.

Anyone have any experience with Dell?

Four questions first.....exactly what are the electronics, when did you buy the electronics, how much did the electronics cost when you bought them, and how much are the electronics worth now?
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

I'm sure this doesn't apply to every case - but I had Dell Financial listed as a secured creditor for a balance of about $40. Was a $1,000 computer purchased about one-year prior to filing.

We have one television, a sound system, and a digital camera purchased early 2009. The current balance is around $2,000. No clue what they are actually worth now.

Dell normally files as an unsecured creditor (it is the "famous" CIT finance company, by the way, that nearly went bust and couldn't get a bailout).
filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

dell in my case didnt even file a claim on $1300 ,if they had it would have been unsecured because it is basically a revolving credit line for their products

Well we dodged the bullet on our 13. We listed Dell as unsecured on about $4400.00. My attorney told me that they (Dell) would probably file their claim as secured, but it would be a wait and see sort of deal.

I was fairly confident that they would file secured as we bought a $1300.00 laptop on the card in February 2009 and a $1200.00 camcorder in December 2009 along with various other small electronics as Christmas gifts.

Surprisingly, to both my attorney and I, they filed as unsecured two weeks ago. Now we await, Best Buy….

No more Credit cards for us ESPECIALLY store issued cards.

Well this gives me hope. I'll see what they do with our claim. Thanks all!

We too had an account with Dell. Ours is unsecured and they get around $ 10.00 a month through our plan. In fact there for a few months, they only got $5.00 a month. Which I think is pretty funny..considering before we filed for Ch13, we tried to make payment arraingments through Dell for $50.00 a month ( normal payment was $75 a month). Guess they wish now that they had accepted our payment plan!! LOL!!
