    Conversion Question

    Question: I am in month 13 of a Chapter 13. I filed a Chapter 7 in September 2003. If I understand the rules correctly, I can file a Chapter 7 in September 2011? Is that right?

    My situation is that I have decided to file for divorce after the first of the year and instead of contend with him not paying his half of the Chapter 13, I want to either split the case or convert to Chapter 7.

    You cannot convert. Conversion means your current case #, file date, etc. is in force. Just changes from 13 to 7. You'll need to dismiss, can file a new ch. 7 case 8 years after your prior case was filed.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)
