What if I legally separate from spouse?

In a chapter 13 now. Can file chapter 7 in May of 2011. If I am legally separated between now and then, what happens to the debt and how can we file a chapter 7? Or can we separately?

I know my buddies wife did it, while they were living together in california. Im seperated and doing a 13 but haven't filed for seperation lawyer told me i just need to show a rent bill.
