Does a monthly expense ck , ( not counted in w-2 as income) get counted in dmi for a chapter 13. My Bf is considering chptr 13, as cannot pass means test for 7.

Yes, all income whether taxable or non-taxable is counted. As always, consult with an attorney....Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11

Thanks we figured he would have To include it. We are about to stop chpter 13 planning, as He just makes too much to get a bad mark on credit report, and have to pay back 100 per cent. They said we could strip the second mortgage. but when they figured it out, we ended up paying the second at 96percent. We are 4 yrs away from retirement, and He could lose his job any day. So attorney said just hang in there until then if you can.chpt 7 ,5-2009Comment
