We got a statement from 1st mortgage (which was one of those stupid option-ARMS that resets like mad) & it said that we have a post petition payment (which like I learned from here stated the disclaimer...not an intent to collect a debt...etc) since we had filed. We are a CH13 & plan to keep the home. The payt was about 300 less & I left msg for atty & called the mortgage company (EMC) we really could use that break for these 3 months that I was told this would be in effect so that was what i paid. Just hoping it doesn't come back to bite me later. Any others experience this?

What is a post petition mortgage payt?

Post petition = after you filed.
Post petition mortgage payments are the ones due after your file date. Anything owed from before your file date goes into the plan to be paid, but you should make all post petition payments on time.
If you mean that your mortgage payment has gone down by $300, I would not spend it just yet if I were you. May need to adjust your plan...Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)

Hi julsmom, i actually received the same thing...also from EMC...and i have no idea what it was...i just sent my mortgage payment via certified mail to EMC with the original mortgage amount that i usually pay (not sure if they received it yet) and now i just received a statement with post petition payment with a lesser amount on what we usually pay before i filed chapter 13..And like yours, it's like 300dollars less...is this another payment on top of the mortgage payment? I'm really confuse abt this, i'm going to ask my lawyer first thing on Monday...
