The hubs and I are divorcing. Sad but necessary. We are 18 months into our plan. The payment isn't outrageous ($759 per month) but we did add one more dependent in March. We are filing for the divorce ourselves. Everything is agreed upon. My question is this.........we have agreed to split the plan payments 60/40........can we just divorce and continue paying our plan or do we have to get into some huge complicated mess?

I'd suggest a quick call to your BK attorney. I've done two pro se divorces and they are pretty easy as long as you both agree on everything. However, judges tend to actively dislike pro se filers, and want to be sure you have worked out every possible tiny detail so that nothing goes wrong somewhere down the road if you end up disagreeing. I have no idea how divorce affects ongoing Ch13 cases, but your attorney should be able to tell you.DH laid off 3/08 | Last mortgage payment 12/09 | Filed Ch13 5/10 | Converted to Ch7 7/10 | 341 held 8/10 | AP filed by secured creditor 10/10 | Ch7 discharged & closed 11/10 | Foreclosure 10/2011
