    Nearing the end, questions

    Hello all,

    First of all, I have been reading a lot of posts here and have learned a great deal already and am very glad I found this forum.

    Okay, my question is this, I'm nearing the end of my Chapter 13 plan, meaning I only $40.00 more dollars to pay and my base plan will be met according to the the 13 data website. My question is this: Is my bankruptcy considered complete when the base plan is met (except for the final discharge)? I want to make sure I'm understanding this correctly, as I think it will be considered complete once the base plan is met. This final $40.00 will be taken out of my pay tomorrow (actually whole amount as per usual for the last almost 5 years). Once the base plan is met, should I be patient and wait to see if the trustee stops the payroll deduction or should I contact the trustee's office or my lawyer (haven't had contact with my lawyer in probably 3 years now)? It seems like what to do may be based on where I live and who the trustee is. I'm anxious for all of this to be done with. Any opinions or thoughts would be greatly appreciated. Thanks in advance.

    Your Ch 13 is complete when the court discharges your case.

    Contact your lawyer now to inform him/her that your base plan is almost met and ask him/her to contact the trustee to see if the wage withdrawal can be ordered stopped as soon as your plan obligations are met.

    It seems like what to do may be based on where I live and who the trustee is.
    Very true. Your lawyer is the most reliable source of information about what to expect in your case.

      Thanks for your response. I took your suggestion and I called my attorney. He put in a request to stop the wage attachment and said he would file a motion for discharge. I found the request for wage attachment on Pacer, but it is still waiting evidently for a signature. He said it could take 30 to 45 days before I get the final discharge. The 13 website is still showing the same, but they seem to be slow to update that.

            If you go into your case and go into documents and click on run (it will ask if you want to view oldest or newest first), it will show you all of the court filings on your case.

              I also got a letter from my Trustee today saying that the wage attachment termination has been done and that my case is in final audit for completion.
