    Legal Clerk

    I know this shouldn't be an issue BUT I just found out that I know the legal clerk at my US office. I shouldn't be ashamed but I really wanted to keep my filing as discreet as possible. Will I ever have to deal with her. The Meeting of Creditors is on another floor from her office. She works for the main office, not the individual Chapter 13 trustess...what's the likelihood of her finding out?

    Probably none at all. Even if your name crosses her desk, she sees THOUSANDS of names a day and likely they don't even register with her anymore. As far as actually dealing with her, I cannot think of a reason unless you are a pro se filer and have actual business that you will be doing at the desk.

    Don't they publish it in the paper where you live anyways?

      I've been trying to read to see what she could possibly do and she MIGHT be the person my paralegal at my law office talks to to have a Chapter 13 trustee assigned. Yes they do but I didn't care about that...the only person that reads that part of the paper is my mother (who of course knows everyone that has filed in our area)! : - )

        If that is her job then I am sure she has seen plenty of people she knows already filing. I ran into a few people at the court house when I had a judgement , and then again when I did my 341 meeting. I just got over the embarrassment and realized that the economy is not in great shape and their are lots of people in my shape. In my 341 meeting there were tons of people attending the 341 meeting. It was sectioned out for every hour and the next hour was no different. The whole floor was packed with people going through a BK. I saw people in their 20's and people in their 70's going through BK. One person's hubby was even having surgery and only his wife could attend.

        So chances are their are a lot of people she already knows who have done BK. I would not worry about it.

          Usually, trustees are automatically assigned so I don't know that the paralegal would be calling to have one assigned. Also, usually they only use case numbers (like I said, names mean nothing when you see thousands a day), hearing dates and times. I wouldn't worry about it.

            I have gotten to that point now...bump it! If she knows. that's fine! Who cares! I get to stay in my house!!

              Don't worry about the clerks or others at the courthouse; who knows, they may have filed themselves; plus they see all the doc.'s etc., that file, and yes, they file bk also.

                I know! A sense of nervousness came over me...she's extended family and has the biggest mouth in the family! BUT oh well, I bet my credit will be better than all of their's 10 years from now! (hopefully)
