    Confirmation

Well I am NEW to this and will be filing Chapter 13 on June 30 with an attorney that I have met with a few times. Now is the time since my home just went into active foreclosure last week! (of course I shouldn't have waited but oh well) My goal is to now save my home and get back on track financially! This forum is choc-full of information but I still have a question about the confirmation with the trustee! If a trustee disapproves your "plan", what happens? Do they just allow you to amend it or do they just say you won't be able to file? Since I will be paying attorney, will they be the one to come up with a "plan" or is that all me?

    Thanks for any help!

You and your attorney will work together on this. You give him (or her) all of your applicable information: Income, expenses, assets, etc. Your attorney then puts together a plan to present to the trustee. If the trustee has objections then your plan would (most times) be amended. Unless your plan isn't feasible at all you should be able to proceed to confirmation without a hitch.

I'm not an attorney. My replies are merely suggestions or observations, not legal advice. As always, consult with an attorney before making any decisions.
