    What if question

    Hello all, about 6 months into a 5 year plan and wife is thinking of going from full time to part time. This would effect our case and then we should qualify for a chapter 7. I know about losing the assets (house). Just wondering how the court looks at a think like this. The reason for this is are child needs attention/ help with school work. Our teen failed almost all of the classes and we are currently trying to figure out why professionally.

    You just need to show changed circumstances. Generally, voluntary decrease in employment is not going to be an issue.

      Thanks HMM for the reply. Would our issue fall under this idea of "changed circumstances" we have the report card, counselors comments and professionals all heading in the same direction that our child needs additional help.

        Great question. We have not yet filed and may not need to....but because of teen issues (more medical related) we are considering the same thing....or possibly even me quitting work. We would still not qualify for a CH7 though which is fine. I also wondered if we would be questioned about a change PRIOR to filing - if we even DO file.
