    confirmation hearing tomorrow

    Tomorrow is our 2nd confirmation hearing, the first one was postponed. Hopefully this one will take place and we get confirmed with no further changes. This time we are scheduled within the 1st hour.

    I heard from our attorney this afternoon and we were postponed again. This time the trustee had a question about how my mortgage was being paid.
    All along my mortgage was outside the the plan payment. We are current and I don't want that payment in the plan. Hopefully next month, the 3rd time, will be the one!

      Hmmmm.....does your trustee think you don't make enough income to pay both your mortgage and your Ch 13 payment? Or maybe he/she is wondering about your DMI and how it was calculated?

      Did your attorney explain the reason behind this third 'push'? *Why* is your trustee questioning your mortgage payment?

        Tonight on Pacer I saw that my attorney submitted another amended ch 13 plan document. This time he included under the mortgage info #5 Curing default and maintaining payments the mortgage information under the "debtor shall pay regular post petition contact payments directly to these creditors". when I looked at an older one, it was not there. So I assume that is why the tt questioned it, because my attorney didn't document it anywhere!!

          I would be furious if this happened to us. In Michigan our 60 month countdown starts after confirmation. Hopefully your attorney has everything in to the trustee now and you can be confirmed soon.

            yea it is pretty annoying. Up until now, I didn't think he had been very sloppy. My 60 months started in February, so that doesn't change, but it would be nice to get confirmed so I can just make our payments and fly under the radar!!

              That stinks. Glad that the clock started in February though.
              We were just confirmed today after having it pushed off in the beginning of May. Our clock also started in February. 6 payments down and 54 to go. :-) I just sent off the July payment.
