    losing job and just filed in April

    My wife and I just filed our Chapter 13 in April. We had our 341 on May 26th. The trustee of course found some things that our attorney is currently working on to amend our plan.

    I am freaking out because I do not have any idea what our payment is going to be. I have not seen the amended plan yet as our attorney is still working on it. Then I talked with my boss and we both agree that within 60 days I won't have a job anymore. We are in the recreational vehicle industry and people just aren't buying. The sales just don't justify both our positions anymore. I don't know how hard it is going to be for me to find an accounting position job after losing this job. I have been with this company for 15 years. I have my AA degree but for an accounting position I think they are going to want more than that as well as somebody who hasn't just filed BK.

    My wife makes enough that rent and normal household bills would be covered. My pay would cover the BK payment and daycare. If our amended plan increases the payment a lot though maybe we are in trouble.

    I have tried to be upbeat and positive for my wife and daughter through losing the house, losing one car, the clubs. We actually enjoy our life much more without all the stress of keeping up pretenses so being upbeat isn't usually hard. Just sometimes it all seem so hard.

    OK, pity party over. Sorry for the long rant. Just needed to vent I guess.

    You really need to pick up the phone and call your attorney to let him know about the upcoming job loss. Since your income will be lost, it may be that you can stop the 13 process since you aren't confirmed yet, and refile as a Chapter 7. Also, you stated that your pay would cover the Chapter 13 payment and childcare. Since you won't have a paycheck (other than unemployment) have you thought about how you will pay the 13 plan payment?

    Please call your attorney. They will know what is best in your particular situation. Good luck to you, I hope you find employment soon!

      If your pay would only cover the ch.13 payment and childcare, you may be able to convert to a chapter 7 and then stay home with the kiddos. You'd be in the same financial position either way.
      Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
      0% payback to unsecured creditors, 56 payments down, 4 to go....

        newbie2-Good suggestion. I have emailed my attorney and called and left a message. Of course so far only his paralegal has called me back. Right now I don't have a notice of layoff or anything. The owner and his right hand man are acting like it is business as usual. My boss and I do the books and we know it is anything but. I would actually prefer it if they would pull the trigger and give me notice because it would make life so much easier to plan.

        momofthree-That would actually be our goal. I would then maybe find something that was a swing shift part time until our little girl was in school full time but that is 1.5 years away.

          Just wondering how it turned out Disneyfan! (I'm a yensid too)

          I'll just throw this in: altho I qualify for a 7, I'd rather do a 13 so that I can keep my house. But my income goes wayyyyyy down in two months.
          An attorney I spoke with who was a trustee said that I'd just do graduated payments...a lot the first two months and then hardly anything the next rest of the plan.

          Just thought I 'd throw that out there !

            Hello ColoradoBell. Yep, huge Disney Fans here.

            Well, my position is done 7/31 so I know I won't have a job after that point. If I have one until then is the question I need answers for and am trying to figure out at this point.

            I have not heard back from the attorney yet but was just kind of letting things coast along. It was yesterday when I found out (via an email and through somebody outside the company) that I was effectively being replaced. Now that I know I will not have a job I will go and sit at the attorneys office if need be so that I can get some answers.

            We have passed the confirmation date with nothing being done so I really am not sure what is going on. It will be nice to be done with the job and no longer sitting there wondering if today is the day the other shoe will drop. It done did drop. Now to just get through the bk.
