    Increasing Family Size

    I was wondering if anyone knew how to go about changing our family size. We are expecting an addition in Nov. Do we redo a means test? Are we supposed to go thru the court or contact the trustee?

    We did everything ourselves and were confirmed in Jan of this year.

    Thanks for any info.

    Is your payment based off of the means test or your I&J schedules?
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....

        First, congratulations on the coming new addition to the family!

        You should let your lawyer know now that you are expecting. Once the baby is born and you get a sense for what the new expenses will be, your lawyer can rework the Means Test and Schedules with your new family size and expenses, then file an amended plan with the court.

        Tallk to your lawyer now about how a new baby might impact your monthly Ch 13 payment. Good luck!

          I've had two kids since filing in 07. The first baby was factored into our payment, but this second one is killing us financially since I went back to work. We are only at 5% payback, and our lawyer said trying to modify could open up a can of worms at this point (we've had pay increases since filing) so we are sucking it up!! If you have room to modify, go for it! My screen name should say Momof4 now!!
