    Claims

    Last day to file claims is tomorrow.

    My truck is a 2009 with a balance of $31000, adequate payments are provided for in my plan but no claim filed yet.

    Same lender as the truck has not filed a claim for a $22000 visa.

    Citibank has not filed a claim for a $43000 visa.

    This is 19% payback plan so that's still around $8000 Citi could recover.

    Guess we'll see @ midnight tomorrow.

    Wow, crossing fingers for you! My creditors ALL filed claims already and my last day for claims isn't until July....
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....

      It's funny about the truck, but I don't know if they need to file one or not to get paid.

      I know they all received notice because none of them have called me since I filed.

        Good for you. Hope no new claims filed. Our last date is the end of July; only a few of the smaller creditors have not filed claims, which is fine by me.
        Hope midnight comes and goes with no new claims for you.
        We are looking for confirmation the end of June.

          You ever wonder if the unsecured creditors who DO file claims are out there hoping others don't file so that they get a bigger slice of the pie?

            Wow, fingers crossed those biggies miss the deadline! I'm perplexed on mine too. None of my large creditors have filed claims yet. Yet being the operative word, they still have a little over a month to do so. Several of my smaller creditors filed quickly, I don't understand it. I'm still hoping the big ones never do, but not expecting it.

              It doesn't matter how many unsecured creditors file claims before the deadline. If a higher dollar cc company files a claim, it just reduces the total amount that every unsecured creditor gets over the life of the plan. It doesn't affect you, the filer, at all.

              Your Ch 13 payment amount is based solely on your disposable income as calculated on the Means Test and Schedules - that's it. No matter how many unsecured creditors file claims, it doesn't change your Ch 13 payment amount at all.

                I know, it's just funny though.

                Citi filed a claim for $44K last night :-) I talked to them a week ago when they sent me a collections letter asking me to pay $44K so I called them and gave them the info so that clued them in. No other filing.

                  Actually, it would affect me. Not my payment amount of course. But my monthly payment is pretty high and so is my percent payback. If my bigger creditors do not file a claim, then my plan will be paid off early. Again, not banking on it, but still hoping. LOL

                    Citi sold off my CC account to some portfolio recovery company. The recovery company filed on my CC, but a had a citi-flexline account for $8500 that had no claim filed. It is goofy the way some will file and some don't.

                      That's what occurred here - they sold it to ELAN and then started to collect 3 months after I filed so I called them and gave them the CH13 details. I have a couple of other CITI cards that did not file. There's still around $40K unfiled. I actually preferred to see them all file, why not - - I'd like to keep the % low. My truck lender did not file a claim, but since they have adequate protection payments in my plan I believe they are fine. They should file for their $20K+ card.

                        The 25th came and went and about $50,000 worth of unsecured failed to file, including a local credit union with a $20K+ balance on one card. They must not need the money. Guess I'll see my payback up to 30%+.
