    Ch 13 and a mortgage mod question

    Has anyone filed for Chapter 13 after completing their "trial modification" payments and sending back their signed and notarized "permanent" documents, but prior to receiving the bank signed copy of the modified agreement?

    I am currently waiting for the bank signed copy to be returned to me (I completed and returned my signed and notarized copies to the bank in mid-April, now just waiting for their signed copy to be returned to me...).

    I am just wondering if there is any reason to wait, as in will a filing jeopardize my modification at this point? I have a cc judgment against me, and I am afraid that one of these days I may have a wage garnishment if I wait too long.

    Did you have to be late on your mortgage to be considered for a mod? Just curious because BofA says I have to be late a few months for them to even consider an in-house mod.

      Hi Free,

      Although I believe that under Making Home Affordable (HAMP) rules you can be current, it always seems that more emphasis is given to those in a state of "imminent default".

      Personally, I was one month late. I figured since my credit was going to go through the wringer for a bk, I did not worry to much about it.

        I completed my mod back in Nov. 09. I never received my copy back from GMAC. As soon as the mod was reflected online and on my paper statements, I considered it a done deal.

        We filed in Feb (4 months after mod finalized), and haven't heard a peep from the mortgage....
        Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
        0% payback to unsecured creditors, 56 payments down, 4 to go....
