    Still not confirmed 5/18/2010

    Just recieved notice that our original plan needs to be amended. The trustee objected to claimed expenses for Childrens (private school) tuition and school related expenses totaling about $800.00. As instructed by our attorney, we need to reassess and revise our expenditures. Because the kids (twins) will be graduating soon we will not have that expense but some of our other expenses have increased (ie. car insurance, real estate tax, home maintenance, and charitable contibutions) since we submitted our original schedule J. My question then is- when we revise the education expenses may we update the others without raising a red flag??
    Also- when the payment changes will it be retroactive to the time of first payment or do we just start with the new amount until the plan is finished??

    You should be able to amend other expenses - though the charitable donations change may be a problem. (From what you said it seems you increased it after filing? Might be seen as an attempt to lower your payment to the plan?)

    I do not know if it is retroactive for certain, best to ask your atty.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      Yes, charitable donation (church) did increase after we filed, so we will nix that one. But as far as the other increases will we need to show six months of statements as we did when we filed? I am afraid our payment will go up greatly, so I am trying to make up some of the diff. with the legititmate increases that I thought would be too insignificant to report, but hey I guess every penny adds up!
