    Stopping wage garnishment

    Hello everyone I am in a active chapter 13 case and am having my wages attached to pay for the plan payments. Have not gotten ahold of my Atty. yet but was wanting to get some info can you have the attachment stopped and just send in money orders instead. Any help with this would be great

    I'm having to pay mine by money order, and... except for some possible glitches at the end of your plan, I think you are better off just letting the wage garnishment stand. As well some districts require it. Paying by money order is a pain in the butt. It costs more. You have to check to be sure it was received and credited each time. I always stress out while "the check is in the mail" that it might get lost. At the end of your plan you will want to be on your toes as far as making sure the garnishments don't continue ad infinitum... as some people have reported this is an issue.

      Hey thanks for the info that is one of the reasons I was wanting to get out of the attachment I have seen some threads with people who ended up paying for well over the plan duration and that is something that I don't want to happen to me since having to pay for this thing for 60 months and paid in almost 36 so far. So thanks again I will wait till almost the end and then tell the lawyer to have them stop the attachment then.

        My husband's check is being garnished as well. Sadly they are now taking 1/2 of his check. The money left is not enough for us to live on, and our attorney really doesn't care.

        What next?

          Yes the money orders suck, I agree. I've started keeping a ledger with each payment and all the relevant dates and serial numbers, in addition to the money order receipts themselves. I think I'm going to switch to USPS. They only charge $1.10 for up to a $500 MO, while I'm paying $0.90 with a limit of $300 so having to buy 2 to make a $400 payment. And USPS only charges $5.40 to track it down if it is lost vs $15 for western union (and I would have to pay 2x that if an envelope gets lost.)
          filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

            Yeah I found that out too and started buying the USPS money orders instead of trying to save a few cents buying them at Wal-mart. It has the added benefit of enforcing my self imposed "I don't have to shop at wal-mart" instead of "well, so long as I'm here...". I'm really enjoying that part. Because I really hate Wal-mart.

              You need to make an appointment to sit down with your attorney. Phone calls aren't going to do it. Have your budget once again in hand and sit with him and ask about amending your plan.

              If you really have budgeted well and still can't live off your plan then something is out of whack and needs to be addressed. Good luck.
