    Notice to employer on Ch 13

    In Oregon does the chapter 13 payment have to be garnished from your wages? That would be so Humiliating for my hubby... . He doesn`t want them to know since he is part of the management team.

    It varies ,state to state and also trustees.Some will allow you to send payments.In Northeast Tn my trustee uses payroll deduction -which shows up as garnishment on my checks.I am a restaurant manager.My supervisor called me one day and asked me if i knew they were garnishing my wages i really enjoyed that.

      It depends on your state. Oregon should have a state website with a link to the court system in your state which should also list the BK court. On most BK court websites for the state in which you reside there will be a listing of requirements and other information for filing Chapter 13 in that particular state. It may or may not divulge whether or not wages need to be garnished for your plan payment. If your state requires it, there is not too much you can do to get out of it; however, if you feel your job may be jeopardized due to that, speak with the attorney you retain for filing. It may be possible to get around it. Please also review your employment contract - many in management have a clause in their employment contract which requires them to notify their employer if they file bankruptcy.
