    Chapter 13

    My bank finally is willing to do a loan mod. I'm into my 2nd year of BK13. Can I ask to be let out of the BK 13 after the loan mod is completed. Or do I have to stay in the BK 13 in order to keep the loan mod? Not sure how all this works. Can I get out of the BK 13 early? I can afford the loan now with the loan mod, but I didn't know if I could be dismissed from the BK 13 early?

    Why would you want to be let out of the 13? Once you are in it, it will stay on your credit regardless. You might as well move forward, get your discharge and your clean slate. You can voluntarily dismiss your case with the help of your attorney but I don't think you should. You would lose the automatic stay and these past two years will have been for nothing without the discharge.

      If you dismiss the 13, then all of your previous debt returns with late fees, interest, and penalties. Is converting to a chapter 7 an option for you? Or were you just filing to keep your house and didn't have any other debt?
      Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
      0% payback to unsecured creditors, 56 payments down, 4 to go....

        Bk 13

        I mainly filed the BK 13 because of foreclosure. There was some debt included in the filing. I didn't know if it would be worth me asking to be let out of the bk because I did file chapter 7 about 8 or 9 years ago. My atty said they will not dismiss this one because of the chapter 7. I had to file chapter 7 due to a divorce. Plus my pay is being garnished and I thought I could get handle on things because the other debt is not that much.
        Just asking, I know I need to talk to my atty.
