    when do chapter 13 payments stop when converting to 7

    I will qualify to convert to chapter 7 in september because my wife will be having our child then. We will be below the median and have less then $100 of disposable income. My question is When can i stop making my chapter 13 payments. Do i have to wait until my attorney files the conversion, thats what im assuming. The day our child is born there is no way we can live on my income and pay the trustee at the same time. I plan on seeing our attorney when the child is born.

    It depends...but you can usually stop making payments a month or so before the conversion. When most people convert, it is because of a decrease in income etc. and no longer have the ability to pay.

    Certainly discuss it with your attorney, but you may usually stop a month before.
