We will be filing chapter 13 in the next couple of weeks. My lawyer says our payments have to be payroll deducted. We are in Middle Tennessee, is there anyone out there who has filed for chapter 13 who has sent direct payments. The payroll deduction thing I feel sure will cause me problems at work. I work for a very judgemental physician, who I know will not understand. When I told the lawyer, this would create a problem for me he kinda laughed and stated he hopes he does fire me for this, then he can take him into another court. While I may not lose my job, I know there will be times where this kind of situation will be critisized by him of he will be talking about politics, and how we should not bail people out who do not pay there bills ect. This makes it very hard to work somewhere knowing this is how he feels, and there are other ways to make someone miserable without firing them on their job. I cannot afford to go somewhere else, as there is no way I could come close to the salary I am making. I work in a small 2 physician office, where he gets just a little too nosey sometimes. I also want to know if anyone can tell me where to find allowable monthly expenses for Tennessee, since this state does not use the IRS guidelines. I am still working on my monthly budget and making sure I am not forgetting something, and using the maximum allowed for food , gas, groceries ect.

While not in TN, my wife and I both have a similar situation.
Our attorney filed motions to prevent wage orders from going into effect. I believe the criteria we had to meet to get the motion approved was "irreprable harm". While the trustee wouldn't stipulate to the motions, they didn't actively fight them either, so after a few weeks the judge signed the orders and now we have payments deducted from our checking accounts (starting in 2 weeks!!!).
The way wage orders are handled are very district specific. Some folks on here are allowed to pay their trustee however they want, other trustees/districts are more strict.
I don't know the specifics of your district, but I would be shocked if the ONLY way to pay would be from wage order.

I really hope someone chimes in from Tennessee that has had experience with this. I don't mind it coming straight from my checking that would save a lot of problems for me. They have to know this is going to cause problems for some of us to have our employer know. I have worked there for 12 years and I know how things are held against people. I appreciate your response, at least maybe I can ask if we could get an order from the judge.

I am in Tennessee and looked into Chapter 13. My lawyer stated that it was likely that payments have to be payroll deducted. I qualify for Chapter 7 so I just decided to do away with all the debts. I am not sure what the allowable monthly expenses for Tennessee are for Chapter 13. I hope someone else can answer this question.Chapter 7 filed on 4/23/2010

Your employer won't know the DETAILS... but the fact that money is getting taken means you ARE paying your debts so it will be obvious you filed chapter 13....
Your boss doesn't need to know if your paying back less than 100%, let him assume you are, if the matter comes up, you could explain that Chapter 13 was a last resort protecting you from lenders that were unwilling to work with you to pay off your debt on a timeline you could afford.

In Northeast Tn.My payroll office was given the letter,however the next day my supervisor called to ask if i knew there was a garnishment against my check.I went ahead and explained that i filed chapter 13 to get out of debt and would be debt free in 5 yrs.I wasnt crazy about everyone there pretty much knowing about it ,but now i can count down the months and i wont have to worry about it in 18 months.
