We recently received our 13 discharge. It was a long long road for sure!
A little history:
Filed 10/05 - just before law changed
12/05 - DH relapsed and went back to using drugs. His business was closed, and he went to rehab for about 2 mos. I called our attorney and was 100% straight with him about what was going on. He contacted the trustee and told him DH had a "medical emergency". The trustee allowed us to reduce our monthly payment of $680 down to $100 (good faith payment) for 4 mos so we could get by. He agreed we didn't need to do a plan modification so long as we made regular payments of $800/mo after this period until we got caught up. It took about 2 years of extra payments each month, but we finally got caught up.
06/08 - Requested permission to incur debt to replace my 9 year old car. Also requested modification of plan to reduce payments of $680 down to $389 to cover much of the car payment. No objections by trustee, plan modification was approved by the court.
3/09 - Asked trustee if I could pay extra$ each month to try and get done our plan early. He said that was fine.
4/10 - Sent last payment to trustee (paid off 6 mos early). I asked the trustees office if there was any way to get an early discharge, as we are trying to get pre-approved for either a new mortgage for another house, or a re-fi on our existing mortgage. The office expedited our discharge, and we rec'd discharge on 4/9. I looked on the 13 data center webstite and see that he made all the final disbursements yesterday 4/12. So now we just await closing.
I can't believe how fortunate we are to have had the trustee we do. I think he is a genuinely caring guy who is ready to give folks the benefit of the doubt. I am glad we were able to complete our plan, particularly when he gave us a much needed chance at the very beginning. Im glad to have been able to prove to him that at the end of the day, its worth giving folks a chance!!
I wish everyone could have such a caring trustee!!!!!
