My wife and I are current on all our debts. We have decided to file for BK 13 and will not pay any more credit cards. Our minimum payment on all our credit card debt is close to $4500/month. Let's say we don't file for BK13 until 6 months later and I have over $20k cash because I did not pay the credit cards. Will I have to claim that as part of my filing? I live in CA so does anyone know how much cash can be exempt when I file for ch 13? Thanks.

See http://www.bankruptcyaction.com/caexemptions.htm for a description of both CA bk exemption systems.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
06/01/06 - Filed Ch 13
06/28/06 - 341 Meeting
07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
08/10/11 - DISCHARGED !
10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

I *believe* that you can use the wildcard to exempt cash. Double check with your attorney though. We didn't have a bunch of cash on hand, so I can't speak from experience. We did have about $12k left over from the wildcard though that our attorney listed on schedule C (exempted items) as "earnings and 2010 tax refund."Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
0% payback to unsecured creditors, 56 payments down, 4 to go....
