I am a creditor of $114k judgement against my ex for unpaid divorce settlement. He filed Ch. 13 in Nov. and about 6 weeks ago my lawyer held a deposition. We are attempting to go after him for bad faith. However, after the deposition, my ex's lawyer was so furious with him for the lies that were uncovered and for my ex misinforming him and the courts of his actual income etc. that his lawyer is now trying to stall confirmation or any further proceedings. My ex's home is on the market and will net a large amount in proceeds if it sells and his lawyer is trying to make him settle with me once the home sells. My question is...how long can confirmation be stalled? If the case moves formward my lawyer will be going to trial to try and have it dismissed on bad faith and it is my understanding that his lawyer is no longer too confident in his clients position after the deposition. I am SO extrememly happy that the deposition uncovered all the b.s. we knew he was hiding...but now how long might we wait??
