    Letter to Mortgage Co. while in BK

    I have filed Chapter 13 myself. I need to write a letter to my mortgage company so that they will discuss my loan modification with me while in BK. Does anyone have a sample letter to send to the mortgage co.? Or does anyone know what has to be in this letter so that the mortgage co. will speak to me?

    Don't send a letter. They get "lost" all the time. Find out the number for the Bankruptcy Department and speak with them. In my case, they had to send an "attorney" release form so that they had permission to speak with me. Since I'm pro se, that just meant me signing the form indicating it was okay for them to discuss the account, since it could be viewed as debt collection.

    Generally speaking, you only need to call in and ask about a modification. They'll see that your account is in bankruptcy and will send you to the appropriate loss mitigation or bankruptcy department.

    Make sure that you ALWAYS get names, and ALWAYS recortd the date and time with home you spoke. Also, get the department name that they work for. There's nothing like rattling off 5-6 names and dates and times when you feel like you are getting the runaround. usually you'll hit on a name that they recognize and say "oh, yeah, Mark... let me get him", and you just saved having to FAX more information! (Yes, this is from experience!)

    I just received a modification on my loan which I'm going to write up in my blog once I get the official paperwork. My modification started in January, but really was the continuation of a modification I started in March of 2008. My filing bankruptcy put a damper on the original modification.
