Once we file-how long before having to make a pymt?

Yes, you have time. I was in a similar situation with Discover back in September. I had been contemplating filing for BK and then I got that letter telling me that if I did not pay in full by the end of the month, they were going to take legal action. There was no way I could pay, so that made the BK decision for me. I retained a lawyer. He told me that I would have at least 2 months before I was served, possibly more. He also advised me to call them and tell them I was filing BK. He said that would probably stop them from doing anything, since it would cost them money for their own lawyers and filing fees for the lawsuit, etc. If they know it won't matter once I file, they likely won't go to the trouble and spend the money. It worked. I called them the day I retained my atty and I didn't file until the end of February, which was 5 months later. I never heard another word from them in those 5 months and was never sued.Filed Ch 13 - 2/2010

Oh my gosh-maybe I should start answering the phone. The lawyer we retained told us to keep his number by the phone and when the creditors call to given them his number. We haven't done that because we want to hold off on filing for a few months in order to save some $. We thought if we gave them our lawyers number that he'd be after us to hurry and file because the creditors would then be breathing down his back. Hmmmm. Very interesting. Thank you-that's good to know!Retained atty 3/2010. Filed Chapter 13 on 1/2013.

I doubt the creditors call the attorney very often. Nothing to be gained, its not like the attorney is going to pay them. (And the only agenda of the person calling is to get payment.) Maybe in a way it lets them know you are serious?Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)
