I am tax case... Here is what will need to happen his 13 will pay the taxes but also right away in addition to his Chapt 13 payment he will need to start making estimated monthly payments of $300 to $400 a month for 2010 taxes now which means yes send a check each month to the IRS with your social on it that states est month tax. For example I just did March I sent a personal check to the IRS for $350.00 says March 2010 Est payment...... so when the year ends you will have paid ahead $4200 for any liabilities you may owe for 2010.... You can raise or decrease the payment to meet your projected needs but if you do this and keep doing this each month then you got a payment pattern of paying ahead and keeps you out of hot water.
Started in Chapt 13 Switched to Chapt 7 Discharged 2009 Dec.........Filed New Chapt 13 in 2010 to deal with new surgery bill and stripped second mortgage! The story continues

Ty for the response car!! I talked to him at about 3. He's already adjusted his with holdings to 0 so he will more than likely get a tax refund every year which will go back into what he owes. He said he is thinking about possibly filing quarterly to help give him an idea as to how this is going to play out. I told him that if he is to get any refunds that he won't recieve this at all and may potentially go to the unsecured creditors and this is what I want him to avoid if he can so it's a bit more money for him and his having to live on a tight budget maybe. Plus that extra money can go to me instead for our son or other necessary living expenses for my husband. Whichever, it doesn't matter. He estimated that he thinks he owes about 44,000 but may be more. He's finishing up his 2009 taxes now so this may be the reason why he said that he doesn't mind having a refund because what he owes in taxes is more than the 44,000. I'm not sure at this point. I know he has been reading this forum, inclusive of what I've been posting but I don't know if he has signed up yet. But I will definitely let him know about this post and thank you for the input. Thank you for everyone's input as it is helping a lot and trying to get all this mess straightened out with both of our BKs.
